This Privacy Policy explains how Agertek handles personal data in connection with the Agertek websites, TechLib product-library service, Android application, TDS portal, contact channels, and related business interactions (together, the “Service”).
1. Scope and responsibility roles
“Agertek,” “we,” “us,” and “our” refer to the Agertek business entity responsible for the relevant website, product catalogue, account, quotation, or customer relationship. Agertek is headquartered in São Paulo, Brazil, and operates an international sourcing, export, environmental-solutions, and feed-ingredients business. Agertek determines why customer, supplier, contact, authorised-user, and business information is used in connection with its operations.
Agertek is the business data owner and primary privacy contact. Agertek determines the business purposes for which personal data is processed, decides who may receive access to Agertek content, manages customer and supplier relationships, and responds to data-subject requests concerning those activities.
Maytek CO is Agertek’s technology provider. Maytek designs, develops, hosts, maintains, and supports the software, authentication, application, portal, integrations, and technical infrastructure used for the Service. When Maytek processes personal data solely to provide those technical services on Agertek’s documented instructions, Maytek acts as Agertek’s technical processor or service provider, as applicable to the governing law and contract. Maytek does not decide product suitability, product safety, regulatory compliance, commercial pricing, supplier selection, customer eligibility, or the outcome of an Agertek transaction.
Maytek may independently process limited technical information where necessary to secure, maintain, diagnose, and improve the technical services it provides, or where required by law. The parties’ actual legal roles depend on the processing activity and applicable law; a contractual label does not override the facts.
2. Personal data we may use
We collect only information that is reasonably relevant to the purposes described in this Policy. The exact data collected depends on whether you visit the public website, contact Agertek, use TechLib, access the Android application, view documents in the TDS portal, or participate in a commercial relationship.

| Usage and preference data | Pages or documents viewed, access events, language or region settings, and choices made in the Service. | Your use of the Service and Agertek’s access-control systems. |
Please do not submit sensitive personal data or another person’s information unless it is necessary for a stated business purpose and you are authorised to provide it.
3. Why we use personal data
Agertek uses personal data to operate its business and provide the Service. Depending on the jurisdiction, the legal basis may include performance of a contract or pre-contractual steps, compliance with a legal obligation, Agertek’s legitimate interests, protection of rights and security, or consent where consent is required. The applicable basis and the available rights depend on the facts, the person’s location, and the specific processing activity.
| Purpose | Examples | Responsible role |
|---|---|---|
| Provide accounts and controlled content | Create and authenticate accounts, apply permissions, deliver documents, maintain sessions, and administer access requested by Agertek. | Agertek determines access; Maytek operates the technical mechanisms. |
| Manage commercial relationships | Respond to inquiries, prepare quotations, communicate with customers and suppliers, coordinate logistics, and administer agreements. | Agertek. |
| Maintain security and reliability | Detect abuse, protect accounts, diagnose errors, monitor availability, prevent unauthorised access, and restore service. | Agertek and Maytek within their respective technical and business roles. |
| Support and improve the Service | Answer support requests, investigate app or portal issues, understand operational performance, and improve workflows and usability. | Agertek for business support; Maytek for technical support and infrastructure. |
| Meet legal and governance duties | Keep records, respond to lawful requests, resolve disputes, enforce agreements, and protect legal rights. | Agertek and relevant service providers as required. |
We do not sell, rent, or lease personal data. We do not use Agertek customer, supplier, or authorised-user content to train a publicly accessible general-purpose AI model without an appropriate legal basis and disclosure.
4. When personal data is shared
Agertek may share personal data with Maytek and other service providers only as reasonably necessary for the purposes described in this Policy, under appropriate confidentiality and security obligations. Agertek may also share information with customers, suppliers, logistics providers, professional advisers, auditors, regulators, courts, law-enforcement authorities, or transaction counterparties when necessary for the relevant business relationship, legal obligation, security, or dispute.
| Provider or recipient | Role and purpose | Important qualification |
|---|---|---|
| Maytek CO | Software development, hosting coordination, application and portal operation, authentication integration, maintenance, diagnostics, and technical support. | Maytek should process Agertek-controlled data only within the agreed technical scope, except where independent processing is required for security, support, or law. |
| Cloud and authentication infrastructure | Account authentication, protected storage, application delivery, backups, monitoring, and security. | The current Maytek TechLib implementation publicly references Amazon Web Services, including Cognito and S3; Agertek should confirm the live providers and regions before publication. |
| Diagnostics and analytics providers | Crash reporting, performance diagnostics, and service analytics where enabled. | The Maytek reference policy identifies Google Firebase for Crashlytics and Analytics; these services should be listed only if enabled for Agertek’s deployment. |
| Business counterparties and advisers | Customers, suppliers, carriers, brokers, laboratories, auditors, insurers, accountants, lawyers, and other parties involved in Agertek’s operations. | Sharing is limited to the relevant business, legal, safety, logistics, compliance, or dispute purpose. |
Some providers or recipients may process data outside your country. Where applicable, Agertek will use the transfer mechanism and safeguards required by the relevant law, which may include adequacy decisions, contractual safeguards, documented risk controls, or another legally recognised mechanism.
5. Retention and deletion
Agertek retains personal data only for as long as reasonably necessary for the purpose for which it was collected, to provide the Service, maintain account and access records, meet legal or accounting duties, resolve disputes, enforce agreements, and protect the rights and security of Agertek, Maytek, users, and other persons.
Account and authorisation records are generally retained while the account or business relationship remains active and for a limited period afterward where needed for security, legal, or contractual reasons. Technical logs and diagnostics are retained for the shortest period reasonably needed for security, reliability, troubleshooting, and legal obligations. Documents and commercial records may be retained according to the applicable contract, regulatory requirement, or limitation period.
When the applicable retention period ends, data is deleted, anonymised, or securely isolated. A deletion request may be limited where retention is required by law, necessary to establish or defend legal claims, needed to protect another person’s rights, or required to complete a transaction or maintain security.
6. Your privacy rights
Subject to applicable law and verification of identity, you may have the right to request confirmation of processing, access, correction, deletion or anonymisation, portability, information about sharing, restriction or objection, withdrawal of consent where consent is the basis, and review of certain automated decisions. Brazil’s LGPD and the EU GDPR, where applicable, provide rights and duties that may differ by context.
To submit a request, contact Agertek at contact@agertek.com with the subject “Privacy Request — Agertek.” Please identify the account, organisation, or interaction concerned, describe the request, and provide enough information for us to verify it. We may request additional information to prevent unauthorised disclosure. Agertek will respond within the period required by applicable law. For account and personal-data deletion, follow the dedicated Data Deletion Instructions.
If your request concerns only technical processing by Maytek, Agertek remains the primary channel for Agertek-controlled data and may coordinate with Maytek. You may also copy privacy@maytek.co for a technical privacy or security question. If you believe your request has not been handled lawfully, you may have the right to complain to the competent data-protection authority.
7. Security, cookies, and children
Security
Agertek and Maytek use reasonable technical and organisational safeguards appropriate to the nature of the data and the risks of processing. These may include access controls, authentication, encryption in transit or at rest where supported by the relevant infrastructure, least-privilege administration, monitoring, backups, and incident-response procedures. No online service can guarantee absolute security, so users must protect credentials and report suspected compromise promptly.
Cookies and similar technologies
The public website, portal, or application may use strictly necessary cookies or similar technologies for authentication, security, preferences, performance, and diagnostics. Optional analytics or marketing technologies will be used only where enabled and where required consent or another lawful basis has been obtained. Browser settings may allow you to control cookies, although disabling necessary technologies can impair the Service.
Children
The Service is directed to business users and is not intended for children. We do not knowingly collect children’s personal data for a purpose that is unlawful or inappropriate. If you believe a child has provided personal data, contact Agertek so the matter can be assessed and addressed.
8. Changes and contact
We may update this Policy when the Service, processing activities, providers, business structure, or applicable law changes. The effective date above identifies the current version. Material changes will be communicated through the website, application, portal, email, or another appropriate notice where reasonably practicable.
